يعلن أمين الإفلاس/ ياسر بن سالم آل طالع عن صدور حكم دائرة الاستئناف الخامسة في القضية رقم (484001565) وتاريخ 1448/03/20هـ، بموجب الصك رقم (452005566) وتاريخ 1448/04/18هـ، وذلك في الاعتراض على حكم الدائرة التاسعة بالمحكمة التجارية بالرياض في القضية رقم (481000176) وتاريخ 1448/02/13هـ، وجاء نص منطوق حكم دائرة الاستئناف الخامسة كما يلي :
أولاً: نقض حكم الدائرة التاسعة بالمحكمة التجارية بالرياض الصادر بتاريخ 5/3/1448هـ والقاضي بـ( أولاً افتتاح إجراء التصفية للمدين/ شركة ايه بي في روك جروب المحدودة ذات السجل التجاري الموحد رقم: (7001564991). ثانياً تعيين الأمين/ ياسر بن سالم آل طالع القحطاني، للقيام بمهام إدارة الإجراء، وفقاً للمهام والصلاحيات والواجبات الواردة في نظام الإفلاس ولائحته التنفيذية. ثالثاً رفع الحجز عن كافة أصول المدين/ شركة ايه بي في روك جروب المحدودة ذات السجل التجاري الموحد رقم: (7001564991)، وتسليمها للأمين) ثانياً: انقضاء هذا الطلب.

Bankruptcy Trustee Yasser bin Salem Al-Tale’ announces the issuance of a ruling by the Fifth Appellate Circuit in Case No. (484001565), dated 20/03/1448 AH—pursuant to Instrument No. (452005566), dated 18/04/1448 AH—regarding the objection to the ruling of the Ninth Circuit of the Commercial Court in Riyadh in Case No. (481000176), dated 13/02/1448 AH. The operative part of the Fifth Appellate Circuit’s ruling states the following: First: Overturning the ruling of the Ninth Circuit of the Commercial Court in Riyadh, issued on 05/03/1448 AH, which decreed: (First: Initiating liquidation proceedings for the debtor, ABV Rock Group Ltd., Unified Commercial Registration No. 7001564991. Second: Appointing the Trustee, Yasser bin Salem Al-Tale’ Al-Qahtani, to manage the proceedings in accordance with the tasks, powers, and duties set forth in the Bankruptcy Law and its Implementing Regulations. Third: Lifting the attachment on all assets of the debtor, ABV Rock Group Ltd. (Unified Commercial Registration No. 7001564991), and handing them over to the Trustee). Second: Termination of this request.
